TERMS OF SERVICE
Disclaimer
1. Clients must be at the age of eighteen and above to commission me.
2. Visual references are absolutely required for commissions. The commissioner will need to provide clear pictures and images of everything that needs to be drawn.
3. Commissioners are required to comply with the terms of service listed here when submitting a commission request to me.This is to inform you that the TOS here will be superseding my previous TOS starting from now for future commissions. Any previous agreements made under the previous TOS are no longer valid. All new commission requests must abide by these terms.Payment
1. For my commissions, I only accept upfront payments. This means that I will need the full payment in advance, before I begin working on your commission.
2. I accept payment transactions through Artistree and Ko-Fi only for orders outside of Malaysia.
3. Commissions for commercial purposes shall be charged with additional fees depending on tiers.Commercial Commission Fees1. The commissioner agrees to disclose any commercial or promotional purposes for their commission before submitting an order, so that the artist may add any fees or negotiate any conditions relevant to a commercial order in advance.
2. Commercial use of the artwork includes but is not limited to things such as using the illustration image in banners or other forms of advertising, using the image in a stream or other broadcasts, and using the illustration in any content or product that will be sold or promoted for commercial purposes.Delivery Processes
1. Commission work is provided solely in the form of a digital product. No physical products are sold or delivered from the commissioned work. All commissioned artwork and illustrations will be delivered only as digital products to the commissioner after completion.
2. All commission work will need to be completed within /at least 4-8 weeks/ time or /at most 5-12 weeks/ time. Please keep in mind when requesting a commission from me, any commissioned work may potentially be subjected to unexpected delays due to problems that may arise throughout the course of creation. Any further delays may result in incomplete or unfinished work due to issues outside of my control.
3. For the finished commissions, I will deliver them through the form of either a .jpg or .png file through email(For Ko-fi) or Artistree website, depending on the place where you had requested the commission.Terms of cancellation or Refund
1. If for any reason you wish to cancel your commission request after I have started on the commission, I will not be issuing you a refund. This means that you will not be refunded any amount of money for the service. This rule is in place because of people who could abuse it and request commission refunds multiple times.
2. I may be unable to finish your commission within the normal delivery process time due to having a lot of queue before yours, which could require a longer delivery period than typical. Should your commission require extra time due to the commission queue, I will not give you a refund within those extra weeks. This is because I was still going to work on your commission, which you had already requested and paid for, so the money would still be going toward your commission.
3. Once the date range between ‘X’ to ‘Y’ days has been reached, and your commission still hasn’t been started on by that point, you are able to request a refund.
4. In some instances, clients may cancel their commission requests on short notice due to last minute events or emergencies that require an immediate cancellation. This is only valid in cases where there’s clear evidence suggesting that the cancellation was truly last minute with no time to begin work on your commission. If requested to, you need to provide proof that the situation caused you to cancel on short notice was a genuine emergency or last minute situation.
5. However, should the commissioner request cancellation after I have already started working on the commission, the commissioner will no longer qualify for any refund. This is because I have already dedicated time and effort into the commission, which they had already paid for. It would not be fair to refund them in this specific situation.
6. Unfortunately, partial refunds will not be accepted for commission pieces once the commission has been agreed upon and payment has been received. This is mainly because of a policy set in place by the sites, which does not have the option for partial refunds or payment. Any refunds that take place would be for the entirety of the order that the commissioner originally made. Thank you for understanding.Communication guidelines
1. All communication must take place on the same platform that the commissioner had initially contacted. Communicating outside of the platform may prevent me from receiving any important information from you during the commission process, and this can result in miscommunication.
2. The Clients and artists should always communicate clearly and effectively when it comes to discussing the commission. When there’s clear communication and a willingness to work together, the project will ultimately have a higher chance of success for both parties. Both parties must make an effort to discuss the details and expectations clearly, so that everything runs smoothly. Additionally, both parties should agree to any terms set in the Terms of Service (TOS) before work begins on the commission.
3. Keep all communication related to commission professional and polite. Treat each other with respect, avoid using any rude language or behavior, and always be receptive to each other's opinions and ideas.
4. If at any point during the process, either party becomes dissatisfied with the commission, they should let the other person know immediately. Open communication is very important, and if there’s an issue with the commission’s progress direction, it’s much better to communicate and address it right away. This will help the commission stay on track and avoid any potential disputes later on.
5. Commissioners should allow the artist to maintain their own art style while making the art piece, as any specific requests may compromise the artist’s creative freedom. The commissioner should express any specific requests in a respectful manner and discuss it with the artist. Any excessive or overly specific requests that cannot be accommodated for, will not resort to the commissioner receiving a refund.
6. Commissioners must also make sure to keep an open mind and be accepting of the artist's style and design choices. The artist may interpret the commissioner’s reference differently than they expected, so it’s important for the commissioner to be willing to work with the artist and not be too inflexible when it comes to the artist’s stylistic choices.
7. While my typical art styles will appear the same as what’s shown on my samples, it is not always a guarantee. My samples are examples of my work, but there will always be differences in how it ultimately turns out after finishing. These differences may include different line techniques, coloring, or even just small differences in the shape or the angle of the drawing.
8. The commissioner should not expect the commissioner’s final commission piece to match the samples perfectly, as there may be small variations in execution.
9. I only take visual references for commissions. The commissioner will need to provide clear pictures and images of everything that needs to be drawn. If any more information or reference material is needed from the commissioner, a request will be sent to them. The commissioner will then be required to fulfill that request within a certain time frame. If the commissioner fails to provide any required reference material or necessary details for the commission, the commissioner will not receive a refund if the commissioner wishes to cancel the commission at a later date.
10. Commissioners are allowed to cancel their commission if I have not started working on the commission within a certain time frame. This gives commissioners a set time range in which they can cancel the commission in case I have not started it yet, and this can also help me to ensure my commission queue is kept to a reasonable length.Privacy policies
1. All information collected from the commissioner during the commission process is kept secure and private. Any information collected will not be shared with other third parties without the commissioner’s explicit permission. Information will not be used for purposes other than the commissioner’s commission request. Information includes things like the commissioner’s real name, their email address, any personal details they choose to give, and any information that they provide during the request form and through email communication.
2. Commissioners also accept that they are responsible for keeping the artist’s information private, including things like their personal information and other personal details that may be collected during the commission process.Commission and changes
1. The commissioner is allowed to request changes to the commission during the process, but this may mean a change in the agreed-upon deadline or other conditions listed within this TOS that the commissioner agreed to prior to the commission beginning. This commission is based on a specific agreement between the artist and the commissioner. Any changes to this agreement must be agreed to by both parties for it to be considered valid.
2. The commission is subject to up to five revisions during the commission process. The artist will work together with the commissioner to make necessary changes. However, in cases such as revisions reached past the limit of five revisions, this could result in higher commissions fees or changes to the timeline agreed upon.
3. I reserve the right to update the terms of service, privacy policy or prices at any time, though I will provide advanced notice to all commissioners before making these changes. I will try to keep anyone who already has a commission request from being affected by any changes. However, future commissions may be subject to these changes and revisions.
4. Prices for commissions are subject to change at the artist’s discretion. Any changes to the prices of commissions will be communicated in advanced notice to all commissioners. Commissions that are signed before a price change will still be completed at the original price.
5. Any unfortunate emergencies that may occur during a commission request such as hospitalization, family emergencies, natural disasters, or other unexpected circumstances may result in temporary suspension or cancellation of a commission. As long as my actions have been reasonable, the commissioner will not be entitled to a refund or other concession in this case.Artist’s rights and conditions
1. As the artist, I reserve the right to refuse service or to make any changes to the commission based on my own discretion. This includes, but is not limited to, the right to deny requests that I deem inappropriate or offensive, and the right to delay or cancel any commission at any time.
2. The commissioner agrees that I will not be held liable for any cancellations or changes I make for these reasons.
3. I do not allow any of the commissioned artwork(s) to be used for any purpose associated with Artificial-Intelligence Generators and non-fungible tokens(NFT).Credit or attributions
1. The artist and commissioner agree that the artist will be properly credited or attributed for any images, artwork, or other content that they create. This may include things like sharing the final product from the commission in a portfolio or by attributing credit directly in the image. Any use of artwork outside of the requested commissions, such as reselling prints or sharing personal images with others, must require the artist’s explicit permission.
2. If the commissioner is requesting a commission that is not going to be used for commercial purposes, they are not allowed to use this work for commercial use. All rights for the artwork will still remain with the artist, and the commissioner agrees to not use the artwork for any commercial purposes without the artist’s explicit permission and consent.Additional notes
1. The artist may offer coupons or discounts to the commissioner that can be used for future commissions. The artist has the right to issue these coupons or discounts at their own discretion, and the commissioner agrees to follow the conditions of each coupon or discount in order to use it.
2. These coupons or discounts cannot be used against existing commission requests, and their use must be agreed upon in advance by the artist and commissioner before the coupon or discount is issued.Rights and ownership
All rights to the artwork created are reserved to the artist. The commission may be used for personal use, but any commercial use of the artwork requires the artist’s explicit permission and consent.
